WELLFLEET CONSERVATION COMMISSION

MINUTES OF MEETING OF APRIL 16, 2003, 4:00 P.M., SENIOR CENTER

Present:  Paul Banner, Co-Chair; Cyndi Moe, Co-Chair;
         John DiBlasio, Virginia Page, Edwin Reynolds,
         Richard Tesson; Emily Beebe, Conservation Agent;
         Erik Mitchell, Assistant; Birgitta Olson, Clerk.

Meeting called to order at 4:05 p.m. by Chair Cyndi Moe.

Business Meeting.
-  The Minutes of the meeting of 4/2/03 were approved as amended,
  as MOVED by DiBlasio, SECONDED by Banner, and CARRIED 6-0.
-  Recommendations on Warrant articles for Town Meeting.
  Change to Environmental Protection Bylaw concerning time for      acting on applications: RECOMMENDED 6-0.
  Transfer of Gull Pond property to Housing Authority:
   Recommendation reserved to Town Meeting; Paul Banner will
  express the Commission's concerns about drainage & storm water
  problems, and wildlife habitat.
-  Building Inspector Richard Asmann was present to discuss zoning
  regulations governing windmills with Commissioners. Section 6.5
  of the Zoning Bylaw was reviewed.
-  A second site visit along the Herring River was scheduled for
  April 29th from the DPW Facility at 9:00 a.m. Herring Warden
  Jeff Hughes will accompany Commissioners.  


5:10. Christopher Glaister, RDA, 50 Arey Way, Map 36, Lot 25:
Cyndi Moe left the table.  Paul Banner took the Chair.  Builder George Moe presented a plan to replace a deck, with the digging of six 30" deep holes for footings.  Ed Reynolds MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3, subject to the following conditions:  (1) ACQ or Kodiak wood is to be used for the posts and framing.  (2) Holes for the posts are to be hand-dug.  (3) No debris or building material is to be dumped in or allowed to migrate into the resource."
SECONDED by Richard Tesson & CARRIED 5-0.  Spvsr: John DiBlasio.

5:20. Amsler Associates, RDA, 313 Main Street, Map 14, Lot 177:
Install catch basin & fence; relocate & improve parking area.
Cyndi Moe took the Chair.  Richard Tesson left the table.  Charles Amsler described this as a 3-year program, with the parking area to be scraped, graded and surfaced with stone.  Emily Beebe felt that the Commission does not have enough information with an RDA, given drainage issues and the presence of a threatened species.  Cyndi Moe noted the presence of a certified vernal pool.  Paul Banner did not see how the problems in this area can be solved without all the abutting businesses being involved.  Ed Reynolds MOVED "that the Conservation Commission make a Determination of Applicability, Positive #1, that is, the filing of a Notice of Intent is required."  SECONDED by Ginie Page and CARRIED 5-0.

6:10. David & Janice Karlen, NOI, 204 Kendrick Avenue, Map 20,
Lot 27:  Septic system upgrade.  Alan Cabral presented the plan, noting that the location of the system is dictated by the locus and abutting wells.  Board of Health approval has been obtained.
John DiBlasio MOVED "that the Conservation Commission approve Felco Plan #98135, dated 1/27/03, subject to conditions specified."
SECONDED by Ginie Page and CARRIED 6-0.  Conditions were set.

6:15. Sueko Hall, NOI, 151 Hamblin Farm Road, Map 19, Lot 12: Driveway & drainage.  Chet Lay presented a plan to construct a driveway over the dike, which is the only dry access to the site.
All drainage from the road will be self contained.  A Variance from the Environmental Protection Bylaw's requirement for a 50 foot buffer strip from the resource is being sought.  Paul Banner MOVED "that the Conservation Commission approve Slade Plans #2003-15 dated 3/4/03 and 2003-32 dated 3/13/03, subject to conditions specified."  SECONDED by Ginie Page and CARRIED 6-0.
Richard Tesson MOVED "that the Conservation Commission grant a Variance from Section 1.03 (10.1 & 10.3) of the Wellfleet Environmental Protection Bylaw."  SECONDED by Ginie Page and CARRIED 6-0.  Conditions were set.  Sprvsrs: C. Moe & V. Page.


Since there was no one present to speak to the Town of Wellfleet
Marina rehabilitation project, it was postponed to 5/7/03 to allow for submission of a construction protocol, plant monitoring conditions, and input from the Shellfish Department, as MOVED by Moe, SECONDED by Reynolds, and CARRIED 6-0.


Other Business.
-  Mail was reviewed.
